Social Security: Special Rules and Medical Vocational Guidelines for Those Over 50

Social Security Special Rules For People Over Age 50Those who are over 50 and applying for Social Security should take note of the special rules called Medical Vocational Guidelines that apply to them. After 50, Social Security uses these rules to decide whether or not they believe someone has the ability to continue to work. These guidelines are in place because entry-level jobs can be difficult for people to obtain as they age. There are many reasons behind this, which include:

  • The person may be over-qualified for the job and require more pay than the organization is willing to provide
  • They may have trouble learning how to do the job due to a gap in generational knowledge
  • They may be close to the age of retirement and the company does not desire to try and find a replacement within a close period of time

Because of this, the work that someone has performed in the past becomes relevant to any claim that the person is filing for Social Security benefits and these guidelines also change based on the person’s age.

These guidelines are best illustrated using some of the examples from above. First, the example of the construction worker with the back injury can be analyzed. This person has spent decades refining and honing their skills which are well-suited to construction work and other manual jobs; however, this back injury would prevent them from using these skills in any meaningful capacity, rendering them unable to perform their job to the best of their ability.

Anyone who is over the age of 50 and feels that they do not have the skills to perform the jobs which they have performed in the past should reach out to Match Disability Law for more information. These guidelines can be challenging to understand and it is a good idea to speak with an experienced legal adviser to make sure that not only the individual but also the family understands all of the options that are available to them. It could make a significant difference in the benefits that are received.

Trying to navigate Social Security on my own seemed futile. It can be a long arduous process. My experience with Marva Match and her team was nothing short of outstanding! There were a lot of complexities involved with my case and they didn’t give up. I’m extremely grateful to Marva for advocating on my behalf. I highly recommend Match Disability Law to anyone going through this process.

My attorney at Match Disability approached my case with compassion. She showed genuine concern for me and my family. In the end she pushed my claim through and it was approved in about six weeks. This will not be the same scenario for many claimant's unfortunately, but my story is proof of the genuine care these attorneys have for their clients. Contacting Match Disability is one of the best decisions I've made.

We have hired Match Disability Law on two different occasions for two separate cases. Both times all of the staff were very helpful and courteous to us as we navigated the difficult Social Security Disability appeals process. I know that it is because of their caring dedication to their clients that both of our cases were approved. Marva and her staff do an excellent job at representing their clients. We recommend them to anyone looking for help after receiving a denial for SS disability benefits. I would give more stars if I could. We are forever grateful for their firm.

I had a disappointing experience with Ms. Match. At the commencement of our experience together I had some conversations with some of her staff. They were professional, and courteous. However, when it came time for the hearing I had two or three phone conversations with Ms. Match in which she was short, rude and condescending - not what I would expect from a professional who has chosen to work with those in very desperate and vulnerable situations. My claim was ultimately denied following the hearing and I had received very little counsel in the nearly twenty or so months it took from applying to the hearing. I feel as though if I had received better counsel I could have won my case as my medical history clearly demonstrates a serious medical issue. I have given two stars instead of one because my dealings with her staff were positive.
