Social Security Disability Denials: The Most Common Reasons Why Claims Are Remanded

Remanded Claims

Remanded Claims

Every day, there are people who are injured and unable to work. Unfortunately, not everyone is going to have their application for Social Security Disability benefits approved, and there are some cases where people who were initially turned down could have their decisions reversed. Even though it is rare for the Appeals Council to reverse the denial of a judge in Administrative Law, it does happen from time to time.

Usually, if the council believes there was a mistake made by the original judge, they will remand the claim and send it back to the judge with instructions on how to alter the evaluation of the case to make sure each element is given fair weight.

During the past few years, the biggest reasons why claims were remanded include:

  • The physical limitations of a person filing the disability application were not properly evaluated
  • The record was improperly developed, inadequate, or otherwise incomplete
  • The mental limitations of the person filing a claim or not properly evaluated
  • The consulting examiner’s opinion was not given appropriate weight
  • After the hearing, new evidence was presented that was not originally available at the time the Administrative Law Judge heard the case and that new evidence has the potential to change the outcome of the application
  • The opinion of a treating source was not identified or discussed during the case
  • Not enough weight was given to a physician who was not examining the individual
  • Not enough weight was given to the physician evaluating and treating the applicant and the opinion of the evaluating physician is not adequately discussed in the decision

These are just a few of the many reasons why the original decision of a judge in administrative law could be remanded. That is why anyone who has had their applicants denied should work with an experienced legal professional who can make sure they exhaust all of their options.
